Hire Agreement Terms and Conditions:
“We”, “Us”, “The Supplier” “Our” – Projectoflix
“The Customer” “You”, “Your”, “The Hirer” The person named as The Hirer on this Hire Agreement.
“Hire Goods” “Rental Equipment” “The Equipment” The equipment rented to the customer by Projectoflix
”Services” “The Rental” “The Rental Service” – The service the customer has paid for including equipment, delivery, set up and collection.
“Available For Collection” Accessible by Us at the Collection Location as stated on this Hire Agreement.
“Security Deposit” – A £100 fee taken before the rental starts that is fully refundable upon the return of the equipment in the same condition it was rented to The Customer.
“Gift” Given to the customer by projectoflix free of charge
The equipment is hired subject to availability. Projectoflix will not be liable for any loss suffered by the Customer as a result of the Goods being unavailable due to circumstances beyond the Supplier’s reasonable control. The Supplier will always aim to first mitigate any risk should an issue arise where the equipment becomes unavailable unexpectedly, and may offer an alternative of similar specification in some circumstances.
Projectoflix requires a fully refundable Security Deposit of £100 to be taken with all bookings additional to the cost of the rental package the customer chooses. The Security Deposit
will be refunded upon the return of the equipment in the same, fully working condition it was in on delivery
By signing this Hire Agreement, You are entering into a legal contract with Us and confirming that You accept the following:
CARE OF THE EQUIPMENT
1 Not remove any labels from and/or interfere with the Hire Goods, their working mechanisms or any other parts and shall take excellent care of the Hire Goods, only using them for their proper purpose in a safe and correct manner, in accordance with any operating and/or safety instructions provided or supplied to You
2 Notify the Supplier immediately after any breakdown, loss and/or damage to the Hire Goods
3 Take adequate and proper measures to protect the Hire Goods from theft, damage and/or other risks
4 Not move or relocate The Equipment to another address other than the one Projectoflix has delivered the equipment to
5 Permit Projectoflix at all reasonable times and upon reasonable notice to inspect The Equipment including procuring access to any property where The Equipment is situated;
6 Not continue to use The Equipment where they have been damaged and will notify the Supplier immediately if the Hire Goods are involved in an accident resulting in damage to the The Equipment, other property and/or injury to any person.
7 It is Your responsibility to ensure that the proper and safe voltage from your property is used with The Equipment. Any damage incurred due to faulty power supply, spikes, surges to The Equipment will result in loss of deposit and remuneration of damaged goods.
8 The Equipment is not to be moved from its installation position where a staff member of Projectoflix has installed it, unless otherwise stated by a staff member of Projectoflix or under conditions stated in point 10 or 11 of this clause.
9 The Equipment must be returned by the Customer to the Projectoflix staff member on the day of collection in good working order and in the same, fully functional condition that it was delivered in, together with all accessories and parts that The Equipment arrived with.
10 If the weather changes during your rental and strong winds or rain start to effect the stability of the screen or put electrical equipment at risk, You will immediately cease using the equipment, deflate or secure the screen, and pack the electrical items away in a secure and dry location as instructed by the Projectoflix employee, ready for collection. Prior to your hire, any risks and mitigations due to weather will be communicated to you by Us, for example if it is already raining on the morning of your hire we will aim to mitigate by providing rain proof covers (subject to availability and size restrictions) or rearrange your booking for an alternative date
11 With overnight rentals, You accept that it is your responsibility to ensure that the Hire Goods are kept safe and undamaged in your garden by securing the garden (by locking the gate to the garden or access ways, for example) and taking all electrical items with a plug inside a secure area that is dry and sheltered. If you cannot offer security at your property or shelter electrical equipment away, then you must notify Projectoflix of this at the time of booking. A Projectflix team member will collect the equipment in this instance the same night after your movie has ended. This will be no later than 12.30am.
12 The projector supplied with the rental is NOT waterproof. This also applies to anything that is fitted with an electrical plug socket. You agree that if the weather changes and it becomes wet or rainy during your rental You will disconnect all electrical equipment at the first possible sign of rain and immediately cease using the equipment and store it indoors in a secure and dry location. Projectoflix does not take any responsibility for damage to the equipment or injury caused by ignoring this warning
LOSS OR DAMAGE TO THE EQUIPMENT
13 If The Equipment is returned in damaged, unclean and/or defective and/or an inherent fault in The Equipment that was not present before the hire started The Customer agrees they will:-
forfeit the Security Deposit up to the maximum amount of £100, plus pay the difference for any additional costs incurred by Projectoflix to repair and/or clean required to return The Equipment to a condition fit for re-hire
14 In respect of any Hire Goods which are lost, stolen or damaged beyond economic repair during the Hire Period The Customer agrees they will:-
forfeit the Security Deposit up to the maximum amount of £100 to cover the cost of downtime and loss of revenue due to not having the equipment available for rehire, and pay the difference to Projectoflix for the new replacement cost for any Hire Goods
DELIVERY, COLLECTION AND SERVICES
15 The Customer agrees that they will be available at the delivery location in order to receive The Equipment on the day of the commencement of The Rental, and allow an employee of Projectoflix to setup the equipment. Failure to do so will result in Projectoflix being unable to carry out the agreed rental service and a Delivery Failure Fee will be deducted from the refundable Security Deposit, as set out in section 29 of the agreement under “Fees and Charges.”
16 The customer agrees that they will be available and present at the location they have requested on the day of collection of the The Equipment for an employee of Projectoflix to collect. If Projectoflix is unable to collect The Equipment on the designated collection day, this will result in a Collection Failure Fee which will be deducted from the £100 Security Deposit as set out in section 29 of the agreement under “Fees and Charges.”
17 To avoid any fees, the customer must contact Projectoflix ASAP if they are aware they will not be available for the delivery or collection day
18 The Customer shall remain responsible and liable for any loss, damage or theft to the Hire Goods until the Hire Goods are collected by the Supplier, unless the Supplier fails to collect the Hire Goods within 5 working days of the agreed collection date whereupon the Supplier shall be liable for any loss, damage or theft thereafter
19 Where the Supplier provides Services, the persons performing the Services are servants of the Customer and once the Customer instructs such person they are under the direction and control of the Customer. The Customer shall be solely responsible for any instruction, guidance and/or advice given by the Customer to any such person, and for any damage which occurs as a result of such persons following the Customer’s instructions, guidance and/or advice, except to the extent that the persons performing the Services are found to be negligent by a court with jurisdiction to make such finding
20 The Customer will allow and/or procure sufficient access to and from the relevant site and procure sufficient unloading space, facilities, equipment and access to utilities for the Supplier’s employees, sub-contractors and/or agents to allow them to carry out the Services. 21 The Customer will ensure that the site where the Services are to be performed is, where necessary, cleared and prepared before the Services are due to commence.
21 The 10% off promotional offer is valid against the Silver, Gold and Platinum packages only. The discount is also valid against Rental Extras between the 01/12/20 to the 22/12/20. The discount will be automatically deducted from the original price at the checkout This discount does not apply to the security deposit. This offer cannot be combined with any other offer. Projectoflix withhold the right to withdraw or extend this offer at any time.
22 To secure a date to hire the Equipment and Services of Projectoflix, the Customer will pay the full amount of their chosen package, plus any additional rental extras, if applicable, and a £100 fully refundable Security Deposit will be required to ensure the equipment is returned in the same condition before the rental started.
CANCELLATION & REFUNDS
23 If you need to cancel or amend your Rental more than 7 days before the Rental is due to start, Projectoflix will fully refund all monies paid to date, or change the date of your Rental free of charge
24 If you need to cancel or amend less than 7 days before the Rental is due to start, Projectoflix charge a late cancellation or amendment fee of £20 which will be deducted from any monies due back that have already been paid
25 If you book in less than 7 days from the start of the rental and for whatever reason you need to cancel and contact Us within 48 hours of booking the Rental, No fees will apply and Projectflix will refund you all the monies paid
26 In the circumstances where weather forecast means that You want to rearrange in less than 7 days, Projectoflix will swap dates free of charge to an alternative date (subject to availability)
27 All cancellations or amendments must be informed in writing to Projectoflix at email@example.com
28 Security deposits will be refunded within 48 hours upon the safe, undamaged, and fully functioning return of the equipment.
FEES AND STANDARD CHARGES
29 Projectoflix withholds the right to waiver the below fees and standard charges on a case by case basis

30 With each Rental package the Hirer will receive £5 cashback when the rental equipment is returned to pay for or towards the cost of a movie rental from a media streaming service the customer holds an account with or has access to. Only 1x £5 cashback per customer per rental.
We reserve the right to amend these terms and conditions and withdraw or extend these terms at any time.
SUMMARY TERMS OF THE EQUIPMENT HIRE
31 You agree If you need to cancel or amend the date of the Equipment Hire, this must be done in writing 7 days prior to the rental commencement date. Failure to do so will result in a Late cancellation or amendment Fee of £20
32 You will pay in full for the chosen package and the Security Deposit prior to delivery of The Equipment.
33 We will return the Security Deposit in full if all of The Equipment is available for collection in the same condition it was delivered in at the End of the Period Of Hire.
34 If any Security, Damage or Failure / Loss fees are required you agree to pay these within 14 days of the End of the Period of Hire.
35 Projectoflix reserve the right to keep the Security Deposit if any of the Terms & Conditions of this Hire Agreement are broken.
36 Projectoflix withhold the right to cancel or change the date of your rental due to poor weather conditions including but not limited to rain or high winds.
37 Projectoflix cannot be held responsible for poor or lack of internet services at a customer’s property. It is the customer’s responsibility to check that their internet connection is adequate to stream a movie from the location that they would like the equipment to be erected at their property. Customers can follow the steps in our FAQs or predelivery checklist to see if their internet connection will be adequate.

Projectoflix understands that your privacy is important to you and that you care about how your personal data is used and shared online. We respect and value the privacy of everyone who visits this website, www.projectoflix.co.uk (“Our Site”) and (subject to the limited exceptions in section 6, below) We do not collect personal data about you unless you contact us (see section 5, below). Any personal data We do collect will only be used as permitted by law.

7.4 We don’t actually store any personal data, we take orders only. The only data we have is from the forms on this website which gets sent to our email address. The data arrives in an inbox hosted on a secure server. We do not use this data for any other purpose only to contact the person to discuss their requirements.

Under the GDPR, no fee is payable and We will provide any and all information in response to your request free of charge. 9. Contacting Us
Yes, all our rentals are delivered on your chosen delivery date, set up by a Projectoflix employee, and collected either the same evening or next day.
We offer collection the same evening at the end of your movie if you cannot guarantee a safe, dry place to store the equipment e.g.inside your home, or you cannot secure your garden to by locking access to it and making it secure as possible from people being able to steal any of the rental equipment.
This depends on the package you choose; each packages comes with a different size screen.
Yes, It is compulsory to watch movies on our media stick that you have WIFI and internet to connect to our media stick in order to redeem the movie voucher we give you or watch your own media services.
Ideally you can do a simple test to see if your internet and WIFI will be suitable for our rental packages.
1) Turn your phone on flight mode and then activate only WIFI on your phone.
2) Walk out of your house and into your garden where you want our rental package to be set up and situated.
3) Go to YouTube.com and try to play a video using purely your WIFI signal from your home.
If the video streams fine without constant buffering (pausing of the video to load) then it will be ok for our media stick too and you should have no problems watching a film with our rental packages.
We would look at the weather forecast a couple of days before your rental is due to commence and also bring a gazebo with us if the weather looked like there was a potential for rain. The gazebo offers shelter from the elements and we would place the seating under the gazebo to keep you dry.
If the weather looked like it was going to be severe on the day of your rental, in terms of torrential rain or high winds, we would then recommend a free of charge date change to rearrange your booking to an alternative date (subject to availability)
We are giving our customers a free Apple TV or Google Play gift card as part of an introductory offer we are doing.
You must have your own Google or Apple account in order to redeem these gift cards.

Most of the time we have a screen to suit small gardens. We cannot guarantee it will fit though because you will need to check the measurements of your garden against our screen sizes here to ensure that it will fit with the width and length.

A member of our team will arrive in the evening of your rental in order to set up your cinema experience. Set up of all the equipment will take approximately 1 hour.
We advise that it is best for our team to come in the evening rather than the morning or afternoon to set the equipment up, due to only being able to see the screen at dusk. The projector’s beam of light isn’t bright enough to see in sunshine conditions, therefore, we would not be able to properly calibrate the screen and ensure everything is set up to our high standards for you, other than when we can see a projected image when the sun starts to go down.
No, you can only watch a movie on our projectors if you have rented a package to go indoors in the daytime with the curtains drawn.
If you are opting for an outdoor cinema experience you can only view the screen with the projector on at dusk.
Damaged or loss of equipment will result in defaulting on up to £100 of the security deposit you have placed on the rental.

All our rentals are overnight rentals. We deliver to you on the day of your rental and set everything up, we then collect the following day.
